PHOENIX TERMS AND CONDITIONS FOR SKIP BIN HIRE
Note: “Phoenix” refers to Phoenix Metal Recyclers Limited and the term “you” refers to you as the customer.
The supply of skip bins and services by Phoenix to you is governed by these terms and conditions which may be amended and updated by Phoenix at any time. As a trade or account holder you will be notified in writing as to any changes made. We will also make this public on our website.

Must be made in full at time of booking via credit card (3% surcharge applies) or bank transfer. If you are an account holder you will be billed with payment expected before bin drop off. The quoted and paid amount is subject to you not exceeding the weight threshold for your skip bin. If over your quoted weight limit you will be charged at the excess weight cost of $20.00 per 100kg.
4. Cancellation:
You are entitled to cancel or alter your skip bin order provided you give us sufficient notice (24hrs minimum). Cancellation or delivery alteration after this time will incur a charge. Should you wish to alter the date of delivery by Phoenix to you we will endeavour to accommodate this but cannot guarantee it. If you require a change of agreed day for skip bin pick up you will need to provide Phoenix with enough notice (24hrs minimum). We cannot guarantee it will be possible and there will be an additional cost for extending days.

You authorise Phoenix to collect, retain and use personal information you provide to us to process payment for our services, or for any other purpose that you authorise, in accordance with our privacy notice. We comply with the Privacy Act 1993, and you have the right to access and correct any personal information we hold about you.
7. Force Majeure:
Phoenix will not be liable for any failure to perform any of the obligations under this agreement during any period, to the extent in which such performance is delayed by circumstances beyond its reasonable control and that could not have been avoided by the exercise of reasonable care, including fire, flood, earthquake, war, embargo, riot, epidemic, pandemic, sabotage, industrial disputes, transportation embargo or the intervention/disruption of any governmental authority.
8. Waiver:
If at any time Phoenix does not enforce any of these terms or grants you at the time indulgence, we will not be construed as having waived that term or its rights or to later enforce that or any other term.
9. Severability:
If any portion of these terms is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.
10. Governing Law:
These terms will be governed by New Zealand law and you agree to submit to the exclusive jurisdiction of the New Zealand Courts.

1. Skip Bin Definitions:
- “General Waste” encompasses most materials you may consider to be rubbish or items no longer of use;
- “Hardfill Waste” refers to materials generally from construction, demolition and renovations that can be repurposed for future projects;
- “Green Waste” is biodegradable and generally composed of garden waste.
2. Use and Care:
You must not:
- Move a Phoenix bin;
- Fill any bin higher than level with the top lip;
- Light any fires or place ash or hot embers in the bin;
- Place any prohibited materials in your bin (see appendix A for this list);
- Fill any bin in an unsafe manner for pick up and transport;
- Mix general, green and hardfill waste unless you have paid for a mixed bin.

- The health and safety of Phoenix employees and you, our customer, is of the utmost importance to us. Both parties must cooperate and act safely in respect to the service provided ensuring that we mitigate the risk of incident.
- You will immediately notify Phoenix of any accident involving our employees or injury sustained to either party caused by or involving our service to you.
- Where required you will assist Phoenix in any health and safety investigation that arises from an incident involving you and Phoenix services.
